Sharon man sentenced to house arrest in sex assault case

Apr. 30—MERCER — A Common Pleas judge on Monday sentenced a Sharon man to house arrest in connection with two cases of statutory sexual assault but warned he could get thrown into prison if breaks the law again.

Ke'sjon Zayquar Allen Smith, 22, of 1061 Woodland Place, pleaded guilty to two Sharon police charges of statutory sexual assault. Charges of involuntary deviate sexual intercourse of a person younger than 16, unlawful contact with a minor and corruption of minors were not prosecuted.

Mercer County Common Pleas Judge Tedd C. Nesbit sentenced Smith to 12 to 24 months less 1 day confinement that may be served on house arrest, followed by 2 years probation.

Smith must also register as a sex offender for 25 years.

Police said one of the cases happened at 2:25 p.m. March 11, 2023, in the sub-100 block of Forker Boulevard. Police said Smith had sex with a 13-year-old and can be seen in a video on social media touching her in a sexual manner.

"I saw he is very apologetic for what he's done," Smith's mother said in court Monday. "I raised him right. He goes to church."

Nesbit asked why he should not put Smith in the state penitentiary, as he normally would in a case such as this.

"He's been going to CareerLink, learning word processing," his mother said. "He will be looking for jobs."

Defense Attorney Stanley T. Booker said Smith has mental health issues.

"He was diagnosed as immature for his psychological age," Booker said, adding that he was also diagnosed with several other mental health issues. "He is apologetic to both victims."

Booker requested that Smith serve his sentence on house arrest.

"He has family support," Booker said. "He's been on house arrest. He's fully complied."

Nesbit said it was very hard for him not to sentence Smith to a state prison sentence because there are two victims.

"If you screw up a little bit I will bounce you to state prison," Nesbit told Smith. "You're going to have a long time to not screw up."
