Is weed legal in Oklahoma?

Medical marijuana is legal in Oklahoma, but recreational use is not.

This means that to purchase weed in the state, Oklahomans must qualify for and purchase a medical marijuana license.

Marijuana laws in Oklahoma

  • State Question 788: In 2018, Oklahoma voters approved State Question 788, legalizing the licensed use, sale and growth of marijuana in the state for medicinal purposes. The state question also imposed a 7% sales tax on medical marijuana sales.

  • The Oklahoma Medical Marijuana and Patient Protection Act: The Oklahoma Medical Marijuana and Patient Protection Act, which was signed into law in 2019, requires applicants for medical marijuana business licenses to provide proof of Oklahoma residency for at least two years, immediately preceding the date of application, or five years of continuous Oklahoma residency during the preceding 25 years.

  • Senate Bill 1704: Passed in 2022, SB 1704 requires employees of a medical marijuana business licensee to obtain a credential authorizing the employee to work in a licensed medical marijuana business. The bill requires that a medical marijuana business license holder shall require their employees to be issued a credential.

  • Uniform Controlled Dangerous Substances Act: The Uniform Controlled Dangerous Substances Act classifies cannabis as a Schedule I substance, meaning marijuana possession without a prescription is illegal.

State Question 820

Oklahomans rejected State Question 820 in 2023, which would've legalized recreational marijuana in the state.

The passage would've allowed dispensaries in Oklahoma to sell cannabis and cannabis products to anyone age 21 and older.
