Records filed within Tom Green County shared that law enforcement was notified about criminal mischief that occurred at Lincoln Middle School. On the morning of Monday, May 13, the librarian reported items being scattered across the room that had previously been placed on a table along with plastic beads being scattered in the server A/V room.

The librarian told law enforcement that an apple was smashed on the wall in a room that had been locked on May 10 before the weekend. “Hand sanitizer had been smeared all over a laptop” in the same room, the affidavit reads. A total of $4 was also found to be missing from a lock box located in the library, despite the librarian stating that she left the library unlocked on accident before leaving for the weekend.

She also stated, “that the criminal mischief appeared to be staged.”

Detectives then spoke with the secretary of Lincoln Middle School who claimed that cash and a check were missing from a safe that had been locked in her office on Monday morning, May 13. The amount of money that was missing included:

  • A check in the amount of $2429.25

  • $160 from a plastic, white bank deposit bag inside the school mail folder

  • $100 from a medical bag

  • $290 from the bottom safe shelf

  • $500 from a black box within the safe

  • $300 from the library bank bag from the secretary’s desk drawer

A total of $3,479.95 was reported missing with $1050 of it being cash.

Records report that law enforcement also spoke with the principal of Lincoln Middle School who was seen on footage at the school on May 11 at around 2:06 p.m. The principal told detectives that he was getting a personnel barbeque grill and had not learned about the criminal mischief or stolen money until he returned to the school on Monday, May 13. He also stated that he did not know that he had set off the alarm at the school when he was seen leaving on surveillance footage at 2:08 p.m.

Footage captured at the school showed Oliver, who is a maintenance worker at SAISD, responding to the school for the alarm. Oliver can be seen entering the school at 2:56 p.m. and not leave for another 38 minutes on May 11.

During his entry, detectives noted that Oliver did not have anything bulging from his pockets.

The affidavit reported that Oliver made his way to the teacher’s workroom where he had clocked in to log his presence at the campus on a time clock. Oliver is then seen going towards the A/V room, where the alarm panel to turn off the alarm is located. However, instead of entering the A/V room, Oliver is captured walking into an unlocked classroom next to the A/V room.

At 3:00 p.m., footage showed Oliver entering the A/V room before making his way back into the hallway at 3:19 p.m. After going into the hallway, Oliver went back into the A/V room for another three minutes before walking to the teacher’s workroom to clock out.

Footage captured Oliver going down a hallway that led to the secretary’s hallway and the secretary’s locked office. It is reported that he remained in this area for 11 minutes before leaving the area with bulges in his pockets and an item sticking out of his right front pocket.

During an interview with detectives, Oliver stated that he was the on-call key carrier for alarms at SAISD schools on May 11. Oliver explained that on May 11, he responded to Lincoln Middle School but only went to the A/V room, the teacher’s workroom and the receptionist’s office. This totaled between 13 to 15 minutes he stated.

The detective asked Oliver about the bulges that were seen in his pockets. Oliver stated that this was due to his work cellphone and that he had not used the phone while he was at the school, however, footage showed the cell phone in Oliver’s hand on May 11. Oliver further shared that he saw no criminal mischief while he was responding to the alarm.

Oliver was booked in the Tom Green County Detention Center on May 22 for burglary of a building. His bond is set at $20,000.
