Report reveals suspect's cause of death, new details in deadly shooting of CCPD officer

Details of the suspect's death in the fatal shooting of Corpus Christi police officer Kyle Hicks on April 20 have been released.

The cause of death of 26-year-old Colten Wade Foster was determined to be homicide resulting from a gunshot wound to the head, according to a Custodial Deaths Report that the Corpus Christi Police Department submitted to the Attorney General of Texas, Ken Paxton, on May 10.

According to the report, Foster died at 12:36 a.m. during an incident that happened in the early morning of Saturday, April 20, that led to the fatal shooting of 32-year-old CCPD officer Kyle Hicks. Several on-duty Corpus Christi police officers had responded to a family disturbance call involving gunshots at the Summer House Apartments on Corpus Christi's Southside at 12:32 a.m., according to CCPD.

On the day of the shooting, CCPD senior officer Travis Pace described how officers arrived at the residence in the 5400 block of Burnham Drive, where they made contact with the man at the door of the apartment where the disturbance was found.

The report states Foster attempted to close the door and flee when he saw the officers. A struggle ensued, with Foster pulling out a handgun and shooting and striking one officer, Hicks, and attempting to shoot a second officer. The second officer returned fire, striking and killing Foster. A later part of the report stated Foster and Hicks were taken to a local hospital, where they both died, but a CCPD officer confirmed in an interview that the suspect died at the scene of the incident.

The report also stated that a woman was found inside the apartment unharmed, and that no other officers were injured.

Hicks died April 24 of injuries suffered in the line of duty.

Foster's identity was confirmed by the Nueces County Medical Examiner's office on April 23. He would have been charged with attempted capital murder of a police officer.

A medical examiner evaluation or coroner evaluation was conducted to determine a cause of death at the time the report was published, with results pending.
