No charges filed after toddler fatally hit by train in Cumberland County

CUMBERLAND COUNTY, Pa. (WHTM)– The investigation into a toddler who was fatally hit by a train in Cumberland County has ended with no charges being filed, Cumberland County District Attorney Sean McCormack said in a statement Tuesday.

The 15-month-old was hit and killed by a Norfolk Southern Train on Dec. 7 at the 400 block of West Main Street in South Newton Township, State Police said in a news release. A spokesperson for State Police said Tuesday that the investigation was closed and did not give any other information.

“After reviewing the Pennsylvania State Police investigation into the child’s death, our office reached the conclusion that criminal charges against the parents were not warranted,” McCormack said.

McCormack said that investigators did not find any evidence that would have supported charges like endangering the welfare of a child or involuntary being filed in the case.

“Depending upon which charge we are looking at, the parents’ actions, or inaction, needs to be knowing, reckless or grossly negligent as it concerns the child’s risk of death or serious bodily injury,” McCormack said.

In a statement, Norfolk Southern called the incident a “tragedy.”
