Muncie man serving 90-year sentence for rape convictions seeks early release

MUNCIE, Ind. — A Muncie man serving a 90-year prison term for sexually assaulting six local women is requesting an early release from prison.

Marvin Wayne Brown, now 63, received the sentence — the maximum allowed under the terms of a plea agreement — in December 2008 from then-Delaware Circuit Court 3 Judge Robert Barnet Jr.

Brown pleaded guilty to six counts of rape after being linked by DNA testing to a series of assaults, all committed in 1992. Investigators said in most of the cases, victims were threatened with a gun or knife.

Barnet called the crimes "totally random acts of terror" that reflected "no respect for human dignity."

Brown at the time was already serving a 20-year sentence imposed by Barnet in 2001 for an unrelated rape conviction.

In a recent motion, Brown noted he had been "incarcerated for 23 consecutive years," and said he had suffered a stroke while in prison, leaving him "permanently medically incapacitated" and requiring his use of a wheelchair.

He indicated he hoped his sentence could be modified "for medical reprieve or geriatric reprieve."

In a response, Delaware County Prosecutor Eric Hoffman said he "has not and will not consent for (Brown) to file a petition for modification of sentence."

"The defendant is, in every sense of word, a serial rapist," Hoffman wrote. "The state of Indiana believes that the defendant poses a substantial threat to the people of the state should he be released from prison."

Brown — incarcerated at the Miami Correctional Facility north of Kokomo — has a projected release date in January 2054, when he would be 93, according to a state Department of Correction website.
