Mitchell man charged with murder after man dies from head injuries in Orange County

A Saturday night fishing trip in Orange County ended tragically when a Mitchell man died after reportedly being hit multiple times in the head by a man who police later arrested.

Homer E. Smith, 46, of Mitchell, was jailed on a preliminary charge of murder after police located him at his mother's home, according to an Indiana State Police news release.

Timothy Tolbert, from Mitchell, was found dead near a fishing pond in a rural area off Winegar Road in northern Orange County.

Lawrence County Sheriff’s Office deputies were the first to arrive at the scene, located near the Lawrence/Orange County line. Police say Tolbert was fishing with a Lawrence County woman when Smith, whom they knew, approached.

The ISP news release said an altercation between Tolbert and Smith ensued, "with Smith striking Tolbert in the head with his fist multiple times." Smith fled the scene after the fight. Tolbert, whose age wasn't available, died there from his injuries. An autopsy is scheduled.

Lawrence County detectives soon located Smith and arrested him. He's being held at the Orange County Jail without bond; a formal charge hadn't been filed as of Tuesday night.
