Man who threatened Burger King employee with gun convicted of attempted murder

DENVER (KDVR) — A jury convicted a 40-year-old man in a string of shootings that took place in Aurora in October 2022, according to the 18th Judicial District Attorney’s Office.

After a five-day trial, Eugene Robertson was found guilty on eight counts of attempted murder, four counts of felony menacing, one count of illegal discharge of a firearm, one count of possession of a controlled substance, one count of harassment and one count of reckless endangerment. The crimes stem from a late-night crime spree that authorities say took place on Oct. 17, 2022, beginning at about 11 p.m.

“This defendant endangered countless lives that night by recklessly firing a gun,” Senior Deputy District Attorney Taylor McCreary said in a release from the DA’s office. “It’s a miracle no one was seriously hurt or killed.”

Sentencing is scheduled for Aug. 9. Robertson faces more than 400 years in prison for his convictions.

“I can’t imagine how traumatized these victims were not knowing whether the defendant would pull the trigger while pointing a gun at them,” District Attorney John Kellner said. “I commend the Aurora Police Department for quickly apprehending this dangerous defendant and ending his crime spree.”

Robertson threatened 7-Eleven, Burger King employees

The Aurora Police Department reported that the incident began when Robertson ordered food in the drive-thru of a Burger King on South Buckley Road. When he went to pay, Robertson offered the employee drugs instead of cash. When the employee declined the offer, Robertson pointed a gun at the employee before driving away, according to police reports.

Officers were dispatched that night to a shooting call at a 7-Eleven gas station on South Airport Road, which is across the street from Burger King. A 7-Eleven clerk told police a man walked in and pointed a gun at his head. When the man saw there was surveillance of the store, he shot the screen and left.

Witnesses said Robertson shot at another person and his girlfriend before leaving. No one was injured in the shooting.

Shortly after midnight on Oct. 18, 2022, Aurora officers were called to an apartment complex in the 18000 block of East Kentucky Avenue. A woman told the dispatcher her friend “Eugene” was knocking on her door, which she refused to open, causing him to fire shots through the door.

The woman had several people in her apartment with her, including children, but none were injured.

“My daughter was here, she snatched her kids and said, ‘Get down, get down, everybody get down,’ and we turned off all the lights,” Shannon Walker told FOX31’s Vicente Arenas in 2022.

Walker told FOX31 she and her family had tried to help Robertson before with various problems, although it was not clear what he wanted this time. Those familiar with Robertson said he had been acting erratic during the days preceding the spree. Other neighbors said the same thing.

“What do you do when someone is shooting in your house? Where do you go? I just panicked,” Walker said.

Robertson lived at a complex near Walker’s home. While investigating the shooting, officers allegedly saw Robertson, who ran and hid in some bushes. He was subsequently taken into custody.
