Harvey Weinstein accuser hopes to see him retried on rape charge

Harvey Weinstein accuser Ambra Battilana Gutierrez hopes to finally have her day in a Manhattan court.

The 31-year-old former model and actress worked with the NYPD to catch the “Pulp Fiction” producer on a wire admitting he sexually assaulted her back in 2015, during a casting call at his SoHo office.

Her efforts helped propel the case by countering the defense’s argument that the sexual encounters were consensual.

The case spurred the #MeToo movement.

She still remembers what happened like it was yesterday.

“It was about 5 p.m. in late February of 2015,” she told The Post. “I was 22 years old and then like five minutes into our conversation he just grabbed my breast.”

The powerful producer tried to kiss her and “was putting his hands on me,” she alleged.

“It was just crazy because I was in a safe place, just outside people were working at their desks and he’s literally a sick person,” she said.

She was never called to the stand when then-Manhattan District Attorney Cyrus Vance won a rape conviction against Weinstein in 2020.

But she may have another chance after a jury overturned the conviction Thursday.

Now, she’d like to see Manhattan District Attorney Alvin Bragg retry the case and give her a chance to be heard.

“This case needs to be retried,” she said. “We have to stop these people who think they have so much power they can do these things.”

In overturning the decision, the court determined prosecutors had prejudiced the jury by allowing them to hear about cases not directly connected to the charges.

Guttierez, who testified against Weinstein in Los Angeles where he is serving a 16-year sentence on a rape conviction, is upset he was able to go on to assault women after her.

“I see what he’s done after me and that’s what makes me very angry,” she said. “I’m really annoyed and upset about the handling by the DA back in 2015. Hopefully, this time, it’s just gonna go on the right way.”
