Driver gets resentenced in death of two Starkey clients

WICHITA, Kan. (KSNW) — It has been almost eight years since Starkely clients Dusty Atterbery, 25, and Dirk MacMillan, 46, died in a crash in west Wichita. Last week, the man convicted of killing them found out he would not have to spend as much time in prison.

The crash happened on May 6, 2016. An SUV slammed into a van operated by Starkey. Atterbery and MacMillan died. Five other people were injured.

Police arrested the driver of the SUV, Bret Blevins. An affidavit said he was legally drunk and had been using meth when the crash happened.

In May 2017, a jury found Blevins guilty of 14 counts, including second-degree murder, involuntary manslaughter and multiple charges of aggravated battery.

In June 2017, a judge sentenced him to more than 700 months, or 58 years, for the crimes.

Blevins appealed, and the Kansas Supreme Court overturned his original sentence because of a “structural trial error” by his previous attorney.

On Friday, Judge Eric Williams resentenced Blevins to 205 months in prison or just over 17 years. Because he has already spent about seven years in prison, he has approximately 10 years left.

Blevins is 64 years old.
