Contractor involved in pool installation scam indicted on multiple theft, fraud charges

MADISON COUNTY, Ala. (WHNT) — A pool installation contractor previously arrested for theft by deceiving clients was indicted in Madison County this week.

In December, Gregory Clay Kirk was behind bars after Madison County officials say he was arrested on charges of theft by deception. 

Kirk was arrested again on Thursday following a grand jury hearing the case this month. He was booked into the Madison County Jail, with a bond set at $475,000.

On Friday, Attorney General Steve Marshall announced Kirk had been indicted on the following charges:

  • 14 counts of first-degree theft of property

  • 1 count of second-degree theft of property

  • 1 count of criminal possession of a forged instrument in the second-degree

  • 1 count of forgery in the second-degree

  • 1 count of fraudulent use of a credit card.

The crimes Kirk is accused of were investigated by the Huntsville Police Department, the Madison Police Department, and the Attorney General’s Consumer Interest Division.

The AG’s office also said Kirk is being prosecuted in Franklin County, where he was indicted in February for first-degree theft of property.

News 19 previously spoke to some of Kirk’s victims who claim he would take their deposits up front then agreed to install a pool but never returned to finish the job.

Jerry and Wendy Scarbrough said he took their money, dug a hole in the ground and never returned to finish the job. Since our story aired, unraveling this scheme a month ago, dozens more of his alleged victims have come forward.

Kirk was still being held in the Madison County Jail as of 3:45 p.m. Friday.
