Baur and Vang back in court for preliminary hearing, receive different outcomes

MANITOWOC, Wis. (WFRV) – Katrina Baur and Jesse Vang appeared back in court Thursday for a continued preliminary hearing that was adjourned last Thursday, March 7, regarding the child neglect case of Baur’s missing three-year-old son Elijah Vue.

Baur waived her right to a preliminary hearing and also withdrew her motion to dismiss count one, the chronic child neglect party to the crime charge.

Because the right to the preliminary hearing was waived, the prosecution does not need to prove that there is probable cause beyond a reasonable doubt that Baur has committed the crimes alleged for the case to move to trial.

Manitowoc County Judge Robert Dewane said that there is sufficient evidence for the case to move forward. Baur is scheduled to have an arraignment on Friday, March 22, at 4 p.m.

“There is a sufficient factual basis to believe there is probable cause a felony was committed and that she committed it,” Dewane said. “I will bind her over for further proceedings.”

Last Thursday, Vang had not yet received a public defender, as he requested one less than a week before the hearing.

“I’d like to exercise my right to due process, to an attorney and to a speedy trial,” Vang said.

Dewane responded that the public defender appointment process for Vang is still playing out, and that if he does in fact request a speedy trial, it has the potential to change the complexion of the proceeding.

“Mr. Vang qualifies for public defender representation. They’ve been unable to find an attorney for him yet,” Dewane said. “As far as how to exercise your right to a speedy trial that needs to be put in writing and sent to the court. If you do that before the next hearing we’ll take that up, and that certainly may change things.”

The court still has not been able to appoint him one. His preliminary hearing will resume after the court has appointed him an applicable public defender. He is due in court on Thursday, March 21 at 10:30 a.m.
