Affidavit reveals new details in shooting death of Smith County 79-year-old
TYLER, Texas (KETK) – An arrest warrant affidavit revealed that the 79-year-old man that was shot on Monday had been arguing with his son about taking care of an injured dog.
According to an arrest affidavit, the spouse of the shooting victim told officers that Dell Tilley and Christopher Tilley, 43 of Tyler, had been arguing all day over who would care for an injured dog that was in their home.

The affidavit stated that once at the Smith County Jail, Christopher told officers that he and his father were arguing about taking care of a dog that was in their home, when his father began to choke him, and he then shot him out of self-defense.
According to the court document, when asked where he and his father were when shots were fired, Christopher told officers at first that Dell was on the ground, but later changed his story that Dell was against a dresser. The affidavit said that Christopher also told officers that he only recalled firing once.
A criminalist determined that the scene did not show any signs of disturbance, according to the affidavit, and that Dell had suffered two gunshot wounds that were fired from close contact into his abdomen, and an additional gunshot wound to his neck/head that occurred near ground level.
