A Chicago couple is suing the hosts of HGTV's Windy City Rehab after their $1.36 million home allegedly started to fall apart within weeks of closing.

According to the lawsuit filed on December 30, James and Anna Morrissey's Lincoln Square home was subject to leaks and water damage as soon as the day after closing, when an upstairs hallway bathroom leaked water onto the the kitchen ceiling below "whenever it was used.'

The couple is alleging that Windy City Rehab hosts Alison Gramenos (who also goes by Alison Victoria) and Donovan Eckhardt are guilty of breach of contract, breach of warranty, defective and shoddy work, and consumer fraud. In the lawsuit, obtained by the Chicago Sun Times, the couple demands a reversal of the sale of the $1,360,000 home, an additional reimbursement of $80,000+ to cover their "upgrades" "landscaping," and an unspecified amount for emotional distress and punitive damages. The lawsuit also involves the show's contractor Ermin Pajazetovic, and the hosts' respective businesses: Greymark Development Group and Alison Victoria Interiors Inc.

The lawsuit states that the couple was promised a new roof "as part of a complete renovation of the property"—but that it was was never installed. Following the sale, said decrepit roof was said to be "causing leaks and water penetration throughout the home—including into the masonry, walls, windows and through the ceiling." Hardly ideal for a brand-new, million-dollar residence.

Other allegations state that "large areas of mortar on the Property's exterior walls were deteriorating or completely missing," and though the team agreed to repairs, they were never performed. Also, an inspector found that "Nearly every window throughout the property was not installed correctly." Nine, allegedly, incurred "visible damage of water infiltration."

In response to our inquiry about the lawsuit, Alison Victoria stated via email today "I worked directly with the Morrissey’s to resolve any issues of concern related to their home renovation," but declined to comment further. The hearing is scheduled for April 28, 2020.
