Johnson & Johnson Agrees to $6.3M Settlement for Infants' Tylenol—And You Can File a Claim

Johnson & Johnson has agreed on a class action settlement for Infants' Tylenol that has them paying $6.3 million, according to a press release from KCC Class Action Services LLC.

Here’s the issue: Infants' Tylenol is no different than Children’s Tylenol, since they contain the same amount of liquid acetaminophen. However, they’re sold as two separate products on the market, and the packaging of Infants' Tylenol depicts a mother holding a baby.

The plaintiff claims that the marketing and advertising of Infants' Tylenol tricks the consumer, who might shell out more cash for something they believe is specifically crafted for infants.

Those in the United States who have bought Infants' Tylenol between October 3, 2014 to January 6, 2020 are considered “Class Members” in the settlement. If you fit this category, you can submit a claim form before April 13, 2020.

According to the press release for the settlement, “Class Members may claim $2.15 for every 1 and 2 fl. oz. bottle of Infants’ Tylenol purchased. A maximum of 7 bottles or $15.05 may be claimed without proof of purchase. An unlimited number of bottles may be claimed with proof of purchase for all Infants’ Tylenol purchases.”

The press release also says that Johnson & Johnson will modify the packaging of Infant’s Tylenol. They’ll also inform consumers that Infant’s Tylenol and Children’s Tylenol contain liquid acetaminophen in identical concentrations.
