Worthington man charged with criminal sexual conduct

May 16—WORTHINGTON — A Worthington resident was arrested earlier this week after a person reported that he raped them.

Late Monday night, police responded to a local residence where a victim had told two friends that they had been raped, and a friend had called 9-1-1. The victim said a friend, Samuel Montez, 29, had been staying at their apartment, and while the victim was lying on the couch, they asked Montez for a back rub, due to an injury.

While giving the back rub, Montez allegedly began touching the victim inappropriately. The victim said "no" multiple times and pushed Montez away, but he reportedly continued to do engage in the touching. He later raped the victim while being told "no," allegedly saying, "It's OK, it's OK."

After the alleged rape, the victim retreated into their room, sending a Snapchat to Montez and asking him to leave because of what he had done. He then messaged back an apology and left the apartment.

In an interview with police, Montez reportedly said that he thought when the victim asked for a back rub, that meant they wanted to have sex.

Montez was arrested and charged with third-degree criminal sexual conduct, a felony that carries a maximum possible sentence of 15 years in prison and/or a $30,000 fine. If convicted, he will be sentenced based on criminal history. His initial court appearance is set for Wednesday morning.
