Ocean County Prosecutor's Office takes over Lavallette Police Department

LAVALLETTE -- The Ocean County Prosecutor’s Office today took over the borough's police department to ensure the "appropriate level of direction and supervision" for the 11-member force, Prosecutor Bradley D. Billhimer said.

Billhimer said the takeover was necessary as the retirement of Chief Colin Grant nears. Grant’s retirement becomes official at the end of the year, but his last day on the job before taking off time that he has accumulated is May 29, the prosecutor said.

The prosecutor's office takeover of the department comes in the midst of a controversy in the borough over who will replace Grant as chief, sources said.

Two of the candidates vying for the position are sergeants Christian LaCicero, who is the son of Mayor Walter LaCicero, and Justin Lamb, son of Councilman Robert Lamb. Justin Lamb is also a councilman in Toms River, representing Ward 1.

Billhimer said he could not comment on who in the department was in line to succeed Grant.

"I met with four individuals from the prosecutor's office this morning," Mayor LaCicero said. "They had been discussing coming over here for probably six weeks, in anticipation of the chief's retirement. There is nothing wrong with the police department."

Billhimer said Grant's pending departure "leaves the department without the appropriate level of direction and supervision. I wanted to have overlap while he’s still there to familiarize ourselves with the day-to-day operations."

In announcing the takeover, Billhimer said he has appointed Anthony Carrington Jr., chief of detectives for the prosecutor’s office, as the officer in charge of the police department.

The prosecutor said he has rehired Joseph Mitchell, who retired last year as the prosecutor’s chief of detectives, to handle the day-to-day operations of the department.

Carrington, Mitchell and lieutenants Brian Haggerty and Thomas Tiernan of the prosecutor's staff arrived at police headquarters shortly before noon this morning to inform officials of the takeover.

Billhimer announced that he had taken control over the Internal Affairs functions of Lavallette police on Dec. 16, after an audit of the department's records.

"We support the men and women of the Lavallette Police Department and will turn our focus to ensuring public safety while preparing the department for the summer season," the prosecutor said. "In addition to providing an officer in charge in Chief Grant’s absence, we will conduct a comprehensive evaluation of the department while instituting appropriate levels of employee management and supervision."

LaCicero said that Chief Grant's actual retirement date is Nov. 1, and that the borough will likely hire a consultant to help with selection of a new chief.

"At that point we will appoint a new chief of police," LaCicero said of the Nov. 1 date. "Testing has already been done through civil service. In between they (the prosecutor's office) are going to help with the transition.

"I understand it," he said of the prosecutor's takeover of the department. "They want to make sure we stay in compliance while the new guy gets up to speed."

Billhimer said the prosecutor's office will work with the borough "to develop a command staff, promulgate updated rules and regulations, and hire personnel to facilitate the department’s accreditation," he added. "Professional and personal accountability will be required of all department employees while the department is under the day-to-day control of the Ocean County Prosecutor’s Office."

LaCicero noted that the prosecutor's office had previously taken charge of Lavallette's police department, under similar circumstances, when former Chief Frederick Swearingen retired.

That happened in December 2003, when the prosecutor's office took over, three months after borough officials had asked for a review of the police department. The takeover happened shortly before Swearingen retired, on Dec. 31 of that year.

In March 2003, Albert Kushinsky -- a 23-year-old Toms River man who was handcuffed -- fell off a porch as he was being removed from a house party, and later died. The prosecutor's office investigated the arresting officer in the Kushinsky case -- then-Patrolman Colin Grant, and cleared him of all wrongdoing.

Retired state police Louis Taranto was hired by the borough as the department's public safety director, to replace Swearingen. In 2005, Taranto selected Grant, who was then a sergeant, as his choice to be the next chief, and Grant took over that year, with the support of the borough council.

Lavallette, located on the northern Ocean County barrier island, has a year-round population of about 2,200, but that number swells during the busy summer tourist season.

The department usually hires about 15 special police officers in the summer months, the mayor said.
