RobertS: This is precisely why judges should NOT BE ELECTED! The judiciary is supposed to be independent. The judiciary is supposed to be governed by the rule of law, NOT the will of the majority. The elected state judiciary is the reason for such much political corruption on a state level. Sure, if they are appointed, they are still often appointed based on a perceived liberal or conservative political slant to their politics, but at least that appointment must be approved by a majority vote of a legislative body, so are there are some checks and balances there. But an appointed judge is not beholding to those who elected him or her. They are able to operate independently, and to arrive at decisions based on the law. And I don't even have a problem with possibly term limiting appointments or having a mandatory retirement age, although I still think impeachment is a sufficient check against corrupt judges. An independent judiciary is crucial to keeping legislators and the executive branches in check. If they are answering to the same people who see to their election, who see to the election of the other branches, how can they possibly be able to do their jobs based on the law, not politics? Just look at Wisconsin and Texas! High courts of both states let their executive branches get away with whatever they want to do. Otherwise, they might not get re-elected.
