Legally, ALL they can do is investigate, and present any evidence found- in either direction- to the Attorney General, who will then decide on a course of action- prosecute, charge, or refuse action due to a lack of evidence. So- a Director of the FBI who does attempt to "write a letter exonerating" the subject of an investigation is thereby committing a crime, and acting WITHOUT proper authority, and should thus be charged himself!
