Trial for Questa man charged under Bennie’s Law delayed until June

QUESTA, N.M. (KRQE) – The trial of a New Mexico man charged under Bennie’s Law has been pushed back until June. William Brown is accused of negligently making a firearm accessible to a minor and is the first person to be charged under Bennie’s Law.

Prosecutors say his son, Porfirio Brown, used the gun to kill a 13-year-old girl in Questa last year. Porfirio’s trial ended earlier this month with a hung jury.

According to court documents, attorneys on both sides agreed to push William Brown’s trial back to give more space between the two cases. William Brown’s trial is now scheduled for June 17.

A Roswell man facing charges under Bennie’s Law will have his trial just weeks later in July. In that case, police say one of Phillip Jaramillo’s guns was used by a minor last August accidentally killing his 10-year-old daughter. Police also say Jaramillo tried to hide the gun in an RV before officers arrived.
