Surfside Beach SC McDonald’s accused of serving raw burger, causing customer to be sick

An Horry County woman claims a McDonald’s in Surfside Beach served her a raw burger, causing her to be sick.

Ashley Montgomery filed a lawsuit against J&L Services, which operates the fast food location.

A representative of J&L Service said Wednesday that the company was unaware of a lawsuit and could not comment. A message was left for the company’s human resources director.

Montgomery alleges that on Dec. 19, 2021, she ordered a burger and while in her car took a bite of the burger. However, the burger did not taste right. She discovered the burger was raw inside and began to vomit, the suit filed March 4 said.

Montgomery returned to the location the same day and showed employees the burger.

Montgomery was diagnosed with food poisoning, the suit said. She suffered pain and medical costs, the suit said.

The suit claims that the business was negligent in serving food that was not “fit for human consumption” and violated the S.C. Food and Cosmetics Act by serving a defective product.
