St. George opponents say ‘looming train wreck’ is coming if rehearing request not granted

BATON ROUGE, La. (BRPROUD) – A response on behalf of Councilman LaMont Cole was filed with the Louisiana Supreme Court regarding the argument that it should rehear the City of St. George incorporation case.

Cole requested that the court rehear the suit and reverse its ruling or reinstate the lower courts’ decisions earlier this month. The newest document is a reply to St. George leaders, who want the Supreme Court ruling that OK’s incorporation to stand.

Attorney Andrew Murrell, spokesman for St. George, said in a recent news conference that the rehearing request was not a concern and that the city would continue to move forward.

In April, the court found that legal error led to lower courts denying the incorporation, and the lower court’s judgment was reversed. The city’s incorporators and electors won the judgment requested.

The lower court said a challenge to the incorporation was the new city’s timely ability to provide services, which will be split between parish- and non-parish-provided. But justices said parish-provided services wouldn’t be affected by incorporating.

In the Friday, May 24, filing, attorneys said they want to “shed light on the looming train wreck that is coming should a rehearing not be granted and the decisions of the courts not be reinstated.”
