Sen. Tommy Tuberville 'all for' Alabama IVF ruling, but emphasizes need for 'more kids'

WASHINGTON − Alabama Republican Sen. Tommy Tuberville seemed to make contradictory comments Thursday on his state's Supreme Court ruling that embryos are considered children, telling reporters he is "all for" the decision but adding, "we need more kids."

The Alabama Supreme Court ruled last week that embryos created during in-vitro fertilizations are "extrauterine children" and legally protected like any child. The decision led some healthcare facilities throughout the state to pause infertility treatments.

When asked by reporters at the Conservative Political Action Conference about the court's ruling, Tuberville responded: "Yeah, I was all for it."

“We need to have more kids. We need to have an opportunity to do that and I thought this was the right thing to do,” he added.

Reporters clarified that the ruling led to pauses of IVF treatments in some facilities in the state and asked if the lawmaker was concerned for the decision's impact on Alabamians.

"That's a hard one. It really is because again you want people to have that opportunity," he said, referencing having children.

The Alabama senator added that he has not seen the decision and has to look at what the court is agreeing to and not agreeing to in the ruling.

He later emphasized on Twitter, formerly X, that the overturning of Roe v. Wade allows states to make their own decisions about life and referenced the Alabama Supreme Court justices who were elected by Alabamians.

"Each and every Alabamian has the right to make their voice heard about these deeply personal issues at the ballot box. I believe every life is a gift and is worth protecting," he wrote.

"Sen. Tuberville was emphasizing his support for life at all stages. In addition to being pro-life and believing life begins at conception, Senator Tuberville is also pro-family. He believes strong families are instrumental to our country’s success. In no way was he supporting the reaction from various medical facilities to cancel IVF procedures in the wake of the Alabama Supreme Court’s ruling. He supports the U.S. Supreme Court’s decision overturning Roe to return decisions surrounding life back to the states, which allows constituents to have a say in these significant decisions at the ballot box."

Tuberville has been a a staunch opponent of abortion, blocking military promotions in the Senate for over 10 months in protest of the Pentagon's policy on abortion and reproductive health, which was created after the Supreme Court eliminated the constitutional right to abortion. The blockade prevented more than 400 military jobs from being filled.
