Newton man sentenced for raping woman with dementia, Harvey County attorney says

NEWTON, Kan. (KSNW) — A man from Newton was sentenced on Monday for raping a woman with dementia.

According to the Harvey County attorney, 19-year-old Le’Rhon A. Hamilton was sentenced to 22 years and 5 months in prison after pleading guilty to rape, attempted criminal sodomy, and aggravated residential burglary on Jan. 5.

In addition to serving time in prison, post-release, Hamilton must be on probation, where he will be monitored and registered as a sex offender for the rest of his life. He will be subject to conditions post release. If he violates those conditions, he could be sent back to prison.

The Harvey County attorney says on July 21, 2023, a 66-year-old woman suffering from dementia reported that a person she did not know came into her house late at night and assaulted her.

The woman was taken to a hospital for the treatment of her injuries and to have evidence collected.

The Harvey County attorney says on Aug. 6, 2023, a person she did not know was recorded in the early morning hours breaking into her home. She was not there, and the suspect left without taking anything.

The woman was able to identify the person in the video as the man who attacked her.

On Aug. 9, 2023, Hamilton was detained by the Newton Police Department.

“The officer observed that his age, build, and general characteristics matched that of the individual in the video from August 6, 2023,” said the Harvey County attorney. “Additionally, he had damage to his glasses that matched damage observed in the video and officers were able to match his tattoos to ones observed in the video.”

Hamilton’s DNA was collected and sent to the Kansas Bureau of Investigation lab for comparison. The results indicated that his DNA matched with the seminal fluid evidence collected from the victim.
