MOBILE COUNTY, Ala. (WKRG) — A Mobile man who was tried in court for a 2018 murder was found not guilty on Wednesday in a unanimous decision, according to court documents.

The jury of 14 people returned its verdict of not guilty of murder around 2:30 p.m. Wednesday for Elenasto Deleon Fox, 40.

Fox was accused of the intentional murder of 37-year-old Joe Dickerson, who was killed on April 9, 2018, on the 1000 block of Prichard Avenue. He was indicted on one count of intentional murder in May 2019.

“While we are disappointed, we fully respect the decision of the jury in this case,” Mobile County District Attorney Keith Blackwood said. “The burden of proof we bear is the highest burden in the legal system and we will continue to fight to meet that burden in every case we prosecute.”

Fox’s defense attorney, John White, said it was a family dispute, and that the state couldn’t prove the identity of the person who pulled the trigger.

“We were very, very happy, obviously, but the sad part about it is this involved family, and it has split this family up to an extent, and I hope they will heal,” White said. “Identity was the issue here.”

“The Defendant is ordered discharged on this case,” the not guilty verdict document read. “The Defendant is to have the electronic monitoring device removed from his person.”
