HUNTSVILLE, Ala. (WHNT) — A 41-year-old man was found guilty of capital murder on Wednesday by a Madison County jury.

Banks’s trial began on Monday. He was found guilty and sentenced to life in prison without the possibility of parole. He was also ordered to pay fines and victim compensation

Officers with the Huntsville Police Department (HPD) said they arrived at the apartments to find Stephon Hussey, 36, suffering from a gunshot wound. Hussey was pronounced dead at the scene.

Authorities said at the time that the incident appeared to be domestic-related.

In an indictment that was returned on May 19, 2023, Banks was said to have “knowingly and unlawfully entered or remained, or attempted to enter or remain, unlawfully in the dwelling of [a woman], with the intent to commit the crime of assault…and while effecting entry or while in the dwelling or in immediate flight therefrom, [Banks] or another participant in the crime, caused physical injury to [Hussey] who was not a participant in the crime.”

Jail records show Banks is still being held in Madison County.
