Man behind McGirt v Oklahoma decision to be released

OKLAHOMA CITY (KFOR) – A Oklahoma man Jimcy McGirt, the man behind the McGirt v Oklahoma case is expected to be released soon on probation.

On Thursday, KOSU reported McGirt, a Seminole member, is set to be released on probation after a judge gave him credit for time already served. Previously, in 2020 the Supreme Court upheld the landmark McGirt v Oklahoma decision and the sovereignty of the Native nations.

Another front is sweeping across Oklahoma today. The threat for severe weather is in far eastern Oklahoma and points east.

According to court documents, McGirt, had been convicted of multiple sex crimes against a child in the Muscogee Nation in state court. After the ruling, McGirt was sentenced to life in prison by federal authorities in 2021, but after an appeal and plea bargain in 2023, he was sentenced to 30 years.

According to the plea agreement, the deal was offered for reasons including McGirt’s acceptance of responsibility for the crime, the age of witnesses and the impact that testifying might have on them.

KOSU reported that McGirt’s attorney says his client will register as a sex offender and will move to a rural location he declined to name.

McGirt is currently being held at the Cimarron Correctional Facility in Cushing.
