Kansas Attorney General Kris Kobach suing over gun background checks

WICHITA, Kan. (KSNW) – Kansas Attorney General Kris Kobach is suing the government over gun background checks.

The rule aims to close a loophole that has allowed tens of thousands of guns to be sold every year by unlicensed dealers who don’t perform background checks to ensure the potential buyer is not legally prohibited from having a firearm. The Biden administration says it is the latest effort to combat gun violence. Kobach says the rule is unconstitutional.

“Really going across the line again and again. And for them to pass this regulation now, it’s we fear; it’s going to Katy bar the door with what they try to do next,” Kobach said.

Kansas is one of 21 states that filed the lawsuit.

Federal report finds 68,000 guns were illegally trafficked through unlicensed dealers over 5 years

Administration officials believe the new rule will impact more than 20,000 dealers (DOJ estimates) who have gotten away with selling firearms without a license and performing background checks at places like gun shows and over the internet by claiming they aren’t “engaged in the business” of firearm sales.
