June trial date set for Marion man held in killing of New Mexico State Police officer

MYRTLE BEACH, S.C. (WBTW) — A Marion man accused in the March 15 killing of New Mexico State Police officer Justin Hare will go to trial this summer, according to federal court records.

Jaremy Smith, 33, pleaded not guilty April 18 to charges including carjacking resulting in death, causing death by the discharge of a firearm during and in relation to a crime of violence, kidnapping resulting in death and interstate transport of a stolen vehicle.

Jury selection and a potential start to the trial is slated for June 10 at the Pete V. Domenici United States Courthouse in Albuquerque.

Smith will remain in custody until the trial begins. If convicted, he faces a mandatory life sentence or death for the kidnapping resulting in death charge, and any number of years up to life or death for the carjacking and discharge of firearm offenses. He could also face state charges in New Mexico, according to previous remarks made by New Mexico Attorney General Raúl Torrez.

He was arrested March 17 by Bernalillo County sheriff’s deputies in an Albuquerque neighborhood, who shot him several times following a brief foot pursuit.

Smith is also facing 17 charges in the death of Pee Dee paramedic Phonesia Machado-Fore.

Warrants show that between 10 a.m. and 2 p.m. on March 13, Smith allegedly entered a residence on Wildwood Loop in Marion County with a Taurus handgun and kidnapped Machado-Fore. Smith is accused of taking her vehicle, a 2001 BMW, and driving it to Jones Drive in Dillon County where he allegedly shot her in the back of the head.
