They fought over custody of a child. Now he faces a murder charge in her fatal shooting.

A 46-year-old man is facing a first-degree murder charge after authorities alleged that he shot and killed a woman this week during a domestic dispute at a home near Lantana.

Palm Beach County Sheriff's Office investigators said Yves Antoine shot and wounded Nancie Elan early on the morning of Monday, May 13, at an address on the 3300 block of Artesian Drive, near Santaluces High School. Elan later died at Delray Medical Center.

A sheriff's report described the incident as a domestic disturbance but did not specify the relationship between Antoine and Elan. Court records show Antoine filed a petition for paternity last month and for custody of a child who lived with Elan.

Besides the murder charge, Antoine also is facing one count of aggravated battery causing bodily harm.

During a court hearing on Tuesday, May 14, at the Palm Beach County Jail, Circuit Judge Donald Hafele assigned Antoine a public defender and ordered that he be held without bail. As a policy, the county Public Defender's Office does not comment on open cases.

According to a sheriff's report, deputies responded to the home, north of Hypoluxo Road and west of Congress Avenue, just after 1 a.m. on Monday. Two men from a neighboring residence described finding Elan lying on the ground just outside their front door and covered in blood.

They then observed Antoine armed with a shotgun and "aggressively approaching" Elan. The men wrestled the weapon from Antoine and pinned him to the ground until law enforcement arrived.

Antoine agreed to speak to deputies after they took him into custody. Portions of his statement to investigators were redacted from the arrest report.

Investigators said he provided varying accounts of the event. He said the disturbance began in front of the neighbor's home, then changed his story to say that it occurred in front of Elan's residence, the report said
