Foreigner faces up to 9 years in prison for helping draft dodgers for over $5,000 per person

A foreigner will be tried in Kyiv for selling fake temporary ID cards to conscripts to help them avoid conscription, the National Police reported.

Under the guise of working for a volunteer division of the territorial forces, the suspect allegedly sold documents for $5,500 to show the potential conscript was unfit for service for health reasons.

The suspect was detained in November 2023 under Article 208 of Ukraine's Criminal Code (detention by an authorized official) during the transfer of a so-called "white ticket". In exchange for the health document, the foreigner received a $2,500 advance.

In its investigation, the police established that the foreigner is from a neighboring country and was born in 1971. He has been staying in Ukraine illegally by using a fake temporary resident permit.

The suspect also promised conscripts that he would influence an employee of the RTRC and Social Support should there be any problems in crossing the border, the police said.

The suspect produced a package of documents for customers to travel abroad as a "volunteer" for $3,000.

The man was suspected of and could be charged with committing several crimes under Ukraine's Criminal Code, including:

  • Part 3 of Art. 332 (illegal transportation of persons across the state border of Ukraine)

  • Part 2 of Art. 15 (an attempt to commit a crime is completed if the person has performed all the actions he considered necessary to complete the crime, but the crime was not completed due to reasons beyond his control)

  • Part 2 of Art. 369 -2 (accepting an offer, promise, or obtaining an unlawful benefit for yourself or a third party)

  • Part 1 of Art. 358 (forgery of an official document by a person who has the right to certify such a document)

  • Part 5 of Art. 27 (an accomplice is a person who contributed to the commission of a criminal offense by other accomplices)

  • Part 4 of Art. 358 (use of a known forged document)

The pre-trial investigation has been completed and the indictment has been sent to the court.

The suspect faces up to nine years in prison.

Ukrainian law enforcement agencies have initiated almost 11,300 criminal proceedings for draft evasion or violation of military registration since the beginning of the full-scale Russian invasion in 2022, the Prosecutor's General Office reported to NV on April 29.
