Florida man cracks open beer after allegedly firing gun near officers: ‘I wanna drink this beer, is that cool?’

PORT ORANGE, Fla. (WFLA) — A Florida man cracked open a beer after he allegedly fired a gun near officers on Tuesday.

The Port Orange Police Department said it received a call about a person being threatened with a firearm by a neighbor.

After officers arrived at the scene, they said the suspect, Brett McPeek, fired a gun near them and several neighbors who were outside at the time.

Officers said they moved toward the sound of the gunshot and found McPeek outside the front of his home with two beers in his hand.

“Do you have a firearm on you?” the officer asked. “No, sir,” McPeek replied.

“This beer is cold, sir. I wanna drink it,” McPeek told the officer. “Come check me. I wanna drink this beer, is that cool? I haven’t done nothing wrong.”

The officer then instructs McPeek to put his hands up. “Right now we are trying to figure out what’s going on, bud, and we wanna make sure everybody’s safe,” the officer said.

Officers continued to negotiate with McPeek and eventually took him into custody.

The police department said McPeek didn’t have a gun in his possession at the time of his arrest. However, they said two guns were found in his home, including a .38 Special revolver with a spent shell casing.

McPeek was booked into the Volusia County Branch Jail on no bond. He was charged with aggravated assault with a firearm and using a firearm while under the influence of alcohol.
