Father of missing Harmony Montgomery indicted on gun charges

The father of missing New Hampshire girl Harmony Montgomery has been indicted on seven gun charges.

Adam Montgomery, 30, was slated to appear in court Tuesday for a status hearing but he was not present to face a judge. New indictments were filed against him, including two counts of armed career criminal, two counts of felon in possession of a firearm, theft by unauthorized taking, and one count of receiving stolen property, according to court records obtained by 25 Investigates.

During the hearing, Adam’s attorneys talked with the prosecution about potential dates for three separate trials. Prosecutors also asked the judge to sever charges against him, separating the gun charges from an assault charge in which Adam is accused of giving Harmony a black eye and a misdemeanor charge of endangering the welfare of a child.

“In that case it made sense the second-degree assault had to do with a time -- a distinct time period --when Harmony’s whereabouts were known. The misdemeanors all have to do with a later time period where Harmony’s whereabouts were unknown,” New Hampshire Senior Assistant Attorney General Jesse O’Neill said.

Earlier this year, investigators charged Adam with second-degree assault, interference with custody, and endangering the welfare of a child.

The now 8-year-old Harmony has not been seen in two-and-a-half years. She was last seen in late 2019 but her disappearance wasn’t reported for more than two years.

Adam’s former wife, Kayla Montgomery, is facing charges related to welfare fraud and receiving stolen firearms. In June, she was charged with perjury after investigators said she lied to a grand jury.

Neither Adam nor Kayla have been charged in connection with Harmony’s disappearance but other charges are piling up, and investigators previously said that they have not been cooperating with the case.

Kayla is free on an appearance bond while she awaits trial. Adam remains in custody.

O’Neill noted that the gun related charges against Adam will be the first of three cases that the state prosecutes as they continue to look into what happened to Harmony.

“I think what’s best about the case is just how different agencies are working hard together to work on what’s a very emotional case. It’s a case that’s gone on a long time. But, spirits remain high. The investigation remains ongoing and strong,” O’Neill said.

Adam’s trial on the gun related charges is scheduled for November. The final per-trial hearing is slated for Oct. 27.
