Family of man killed in 2023 Baton Rouge police chase files wrongful death lawsuit

BATON ROUGE, La. (BRPROUD) — The children of a man who was killed in 2023 during a police chase have filed a lawsuit against the Baton Rouge Police Department and two of its officers.

Court documents state that in March 2023, Victor Duncan Sr. was driving home in a 2008 Ford truck on North Acadian Thruway West in Baton Rouge. Simultaneously, BRPD detectives Tyler Bennett and Joseph Carboni were trying to stop Bryan Jones on Florida Boulevard regarding a broken tail light.

The attempted traffic stop turned into a high-speed chase. Court documents note that Jones was driving 25 miles per hour over the posted speed limit, disregarding traffic signals and the safety of others.

During the chase, Jones crashed into Duncan’s vehicle at the intersection of North Acadian Thruway West and Fairfields Avenue, killing Duncan. Jones was charged with manslaughter.

The lawsuit accuses Bennett and Carboni of violating the Baton Rouge Police Department’s policy for vehicle pursuits by “traveling at excessive speeds in a reckless manner, continuing to pursue a non-violent individual and failing to terminate the pursuit.”

GoAuto, USAA Casualty Insurance Company, the city of Baton Rouge and East Baton Rouge Parish were also listed as defendants in the lawsuit.
