UPDATE: Etowah County teacher cleared of child porn charges

UPDATE: An Etowah County grand jury found no evidence to pursue any of the charges against Amy Sudberry or her husband.

An Etowah County grand jury found A cyber tip led to the search of a residence and the arrest of a third-grade teacher and her husband Monday night, according to Rainbow City Police Lt. Jason Higgins.

Amy Bedwell Sudberry, 39, faces three felony charges: production of pornography with a minor, possession of pornographic material and chemical endangerment of a child.

Her husband, Joshua Wayne Sudberry, 33, was charged with chemical endangerment of a child and possession of drug paraphernalia.

According to the Carlisle Elementary School website, Sudberry is a third-grade teacher there.

Higgins said the investigation continues and investigators have not combed through all the contents of Amy Sudberry's phone, but thus far they've found no indication the crimes she is accused of involved any students at the school.

"The Etowah County Board of Education is aware of criminal charges against an employee, Mrs. Amy Sudberry," Superintendent Alan Cosby said in a statement.

"This employee has been placed on leave pending the outcome of this matter," he said. "We are cooperating fully with law enforcement and will have no further comment as this is a personnel matter."

Higgins said when police executed a search warrant at the residence, they found drug paraphernalia, such as pipes, with residue of marijuana and a white substance, allegedly connected to Joshua Sudberry, within reach of a child, resulting in the child endangerment charge.

They seized evidence that is still being investigated in relation to the pornography charges.
