Despite lawsuit, Beckley Common Council searches for city manager

BECKLEY, WV (WVNS) — Despite a lawsuit which seeks to null a January 2024 vote by Beckley Common Council to change the city’s form of government, Beckley Common Council continued to search for a city manager on Friday, April 19, 2024.

Ward 3 Councilman Robert Dunlap said that Council had held workshops, and city officials were actively recruiting suitable candidates.

“If we don’t have everything in place, we’re going to be in a position where the mayor just has to appoint someone,” said Dunlap. “We may still have to have the mayor appoint someone for an interim period of time, but we can’t fall asleep at the switch, just because it’s an election year. We’ve got to do our very best for the voters.”

Councilman Dunlap, who is also an attorney, said he believes Council followed the law when changing the form of city government from that of a strong mayor to a system of weak mayor and city manager.

Beckley businessman Doug Epling is the plaintiff in the lawsuit, which argues Beckley Common Council did not follow the city’s charter when voting to change the form of government.

Attorneys for they City of Beckley asked Raleigh County Circuit Court Judge Andrew Dimlich on Friday, April 19, 2024 to dismiss the lawsuit.

Judge Dimlich was considering the request and said he would issue a judgment at a later date.
