Defence awaiting disclosure of evidence in Sackville manslaughter case

A 22-year-old Sackville man accused of manslaughter in the death of a 44-year-old man in the southeast New Brunswick community returned to court Monday.

Tyler Murphy is accused in connection with the stabbing death of Shawn Mitton on March 16.

Murphy originally faced a charge of second-degree murder and was accused with his brother, Dylan Murphy.

The charge against Dylan Murphy was dropped, and Tyler Murphy's charge reduced to manslaughter at a previous appearance.

On Monday, Tyler Murphy appeared in Moncton provincial court, where defence lawyer Pierrette Allain asked for a month-long delay in the case. Allain said they've received an initial portion of the Crown's evidence but are awaiting another portion.

Judge Luc Labonté scheduled the case to return to court June 10 to set dates for a preliminary inquiry. The inquiry is held to test the Crown's evidence before a case proceeds to trial.

Tyler Murphy remains in custody.

RCMP previously said officers were called around 7:45 p.m. on March 16 to a report of a stabbing outside a business on Lorne Street in Sackville.

Police said a man was lying on the side of the road with stab wounds. The man was taken to hospital, where he died of his injuries.

The brothers were arrested and charged March 17. The charge against Dylan Murphy was withdrawn March 27.
