Convicted felon facing 15 counts, including DWI and gun possession, following traffic stop
BUFFALO, N.Y. (WIVB) — A convicted felon from Batavia was taken into custody following a traffic stop that led to multiple charges against him, according to the Wyoming County Sheriff’s Office.
On April 30, just after 4:30 a.m., 22-year-old Cristian M. Deluna was allegedly driving 20 mph over the speed limit in the Town of Java. During a traffic stop, officials said they saw the driver and passenger switch seats. Deluna was identified as the driver and was asked to exit the vehicle, they said.
Officers allegedly found a loaded ghost gun in his waistband. He also showed signs of possible impairment, according to the Sheriff’s office. Following his poor performance on a sobriety test, Deluna was arrested for driving while intoxicated, they said.
According to the Sheriff’s office, an investigation into the 22-year-old found that he was a convicted felon on probation, he did not possess a NYS pistol permit, and he had three orders of protection against him. A semi-automatic rifle was also found in the back seat of the vehicle, they said.

second-degree criminal possession of a weapon – loaded firearm
third-degree criminal possession of a weapon – large capacity magazine
fourth-degree criminal possession of a weapon – ghost gun
fourth-degree criminal possession of a weapon – convicted felon
aggravated family offense
three counts, second-degree criminal contempt
aggravated unlicensed operation
second-degree aggravated unlicensed operation
third-degree aggravated unlicensed operation
driving while intoxicated
speed over 55 mph
failure to keep right
refusal to take preliminary breath test
