For months now, K-Fed had been threatening to take his superstar ex to court to increase the $20,000 monthly child support payments he receives for their two sons, Sean Preston, 12, and Jayden James, 11. After private negotiations failed, he has filed the legal papers, according to Blast. The gist of his argument is that their agreement was worked out in 2007, when she was making less money (Forbes recently estimated her annual income at $34 million a year) and he was making more (a remarkable six figures). For those wondering what exactly he does these days … well, the onetime backup dancer is a DJ, and of course a father of six — two from his pre-Britney girlfriend Shar Jackson (Kori, 15, and Kaleb, 13) and two post-Britney with his second wife, Victoria Prince (Jordan, 6, and Peyton, 4).
The legal docs paint Federline — who is seeking $60,000 a month, according to his attorney — as financially inferior to the pop superstar, saying he makes less than 1 percent of her annual earnings — “approximately $3,000 per month” without her additional $20K. Federline, who splits custody with 36-year-old Spears, wrote: “My income has changed significantly since the child support was last modified in approximately 2008 because I no longer earn a six-figure income like I did in 2008. I am no longer able to perform as a dancer due to my age, and I have not been as successful in putting out new music as I was in 2008. I am simply less of a ‘name’ and less in demand than I was in 2008, which has negatively affected my income.”
The legal papers delve into the “extreme disparity between the lifestyle enjoyed by” Preston and Jayden at Federline’s house versus Britney’s. “Petitioner is a single woman who lives alone in a 13,264 square foot Neoclassical Italianate villa on 21 acres of land in a gated community with an elevator, a library, a media/game room, 3,500 bottle wine cellar, an additional 1,200 square foot pool house, an orchard, resort-sized pool and spa, lighted tennis court and three-green golf course,” the papers state. “In contrast, Respondent lives with his wife, his two minor children from his current marriage, the two minor children he shares with Petitioner and two minor children from a previous relationship in a 2,000 square foot home.” They note that the kids have chefs, tutors, caretakers, security, and “every video game system imaginable” chez Brit. And they go on at length about the children’s vacations “multiple times a year” with her in “the finest 5-star resorts.”

Federline didn’t hold back about what he would be spending the money on if the amount were increased, including better digs and vacations. The papers noted that unlike Spears, he “cannot afford to take the minor children on vacation or purchase the consumer goods unendingly provided to the minor children.” Nor can Federline’s home “accommodate having their 15 friends over … for a sleepover due to a lack of space.” He requires “an upward modification of child support” so he can “secure housing and services they require to be able to meet the needs of the parties’ minor children” while they’re in his care.
And of course the paperwork brought up Spears’s 2007 breakdown, noting that it led to the implementation of Spears’s court-ordered conservatorship, which remains in place to this day.
Federline’s attorney, Mark Vincent Kaplan, subsequently spoke with Us Weekly and got specific about the money, saying his client deserves three times the child support payments — meaning $60,000 a month.
“Kevin is asking for the reasonable needs of the children to be met, which is at least three times the amount Kevin is currently getting,” Kaplan said. “This is based on her earnings which have been publicly reported. We are also asking for attorney’s fees, because it didn’t have to come to this.”
A rep for Spears has not yet responded to our request for comment, but earlier this year, Us Weekly reported that Federline “flatly rejected” a financial proposal offered by Britney and her dad, Jamie Spears, who is her conservator.
As these behind-the-scenes negotiations played out in the headlines over the last few months, Federline made light of his play for money. At a DJ gig for his 40th birthday at a strip club in Vegas, he was given a cake featuring stacks of cash.
And all this pretty much fits perfectly into the “chaotic” saga of Britney and Kevin, who were together for just two years.
