Braintree woman sues Quincy, citing injury at city garage; city says she has no proof

QUINCY – A Braintree woman is suing the city of Quincy after she said she was seriously injured when a piece of metal flashing came off the roof of the Kilroy Square Garage and hit her in the head.

But Quincy Assistant Solicitor Steve Durkin said she was struck by a plastic light cover that weighs a few ounces. He said he hasn't been provided with any evidence that the woman was injured or got medical treatment.

Jodi Solimando, on March 8, 2022, was walking outside the city-owned Kilroy Square Garage on Cottage Street when she was struck in the head by metal flashing that came off the roof, according to the lawsuit filed in Norfolk Superior Court. Solimando said it caused her to fall and lose consciousness.

The city-owned garage on Cottage Avenue, formerly the Hancock parking lot, opened in December 2019. The garage cost $50 million to build.

Solimando is seeking $100,000, plus interest and expenses. Her attorney, Steven Kfoury, did not respond to a request for comment for this story.

The lawsuit states Solimando "was and still is seriously, severely and permanently injured, has incurred and still incurring expenses for medical care and attendance, sustained and is sustaining severe pain and mental anguish, disability, and has incurred and continues to incur loss of earnings and earning capacity and is unable to carry on her usual activities and duties."

The city's "negligence and carelessness" allowed the roof of the garage to be in a dangerous condition, resulting in the injury, the lawsuit states.

Durkin, the assistant solicitor, said he's seen the surveillance footage and it doesn't appear Solimando was injured as she states by the piece of plastic.

"She's alleging a head injury, but I haven't received any documentation of any sort of injury – no doctors letters or diagnostic reports or hospital records," he said. "You can count me as skeptical. ... I don't have anything to support this claim."
