Colorado theater shooting suspect James Holmes due in court Monday

AURORA, Colo.--Suspected mass killer James Holmes will make his first appearance in a Colorado court Monday morning.

Holmes, 24, was arrested early Friday shortly after allegedly opening fire inside a packed movie theater in suburban Denver. Seventy people were killed or injured. The 12 who died ranged in age from six to 51. The rampage was one of the worst in U.S. history.

It was about 15 minutes into "Dark Knight Rises" when Holmes, dressed in full combat gear, allegedly entered through an exit door carrying three guns, including a military-style rifle capable of shooting 50 to 60 rounds per minute.

Police said Holmes didn't resist when officers arrested him behind the cinema, but repeated on Sunday that the suspect is not cooperating with investigators. Aurora Police Chief Dan Oates said that Holmes, a former student at the Univ. of Colorado-Denver medical school, has "lawyered up" and is not talking, according to the Associated Press.

Authorities said Holmes, who is being held in solitary confinement, will be represented by public defenders on Monday.

The number of charges he faces--and whether prosecutors will seek the death penalty--has not been determined. The case could eventually be transferred to a federal court, but Oates said authorities were leaning towards a state prosecution.

Monday's hearing will be at 9:30 a.m. local time in the Arapahoe County District Court, with Chief Judge William Blair Sylvester presiding.

A court spokesman told Yahoo News that Holmes, who will be advised of his rights during the hearing, will appear in person and not via video conference.
