  • Mary-Kate Olsen's request for an emergency divorce filing has been rejected by a New York Supreme Court judge.

  • Olsen reportedly requested an emergency divorce earlier this week, but the request has been deemed "not essential" by the New York City court.

Mary Kate Olsen's request for an emergency divorce from Olivier Sarkozy has been rejected by a New York judge.

According to People, Olsen's emergency order was deemed "not essential" enough to be processed right away. Due to the COVID-19 pandemic, New York City is not currently accepting any new divorce filings unless the requested filing is seen to be an emergency situation. New York courts spokesman Lucian Chalfen also confirmed to the outlet that Olsen did not follow the "essential matter procedure" needed for the specific filing.

"We are only accepting essential/emergency matters for filing. The original filing was rejected by the New York County Clerk because they did not follow the essential matter procedure," explained Chalfen. "They refiled under the essential matter procedure and the matter was referred to the ex parte judge a New York State Supreme Judge. He decided that it is not essential so they can’t file anything at this point."

TMZ first reported that the fashion designer originally signed a divorce petition on April 17, but submitted the emergency petition earlier this week due to her worry that Sarkozy would rid their shared Manhattan apartment of her belongings. Reportedly, Sarkozy's lawyers contacted Olsen stating that she needed to be out of their shared apartment by May 18. The request influenced Olsen's emergency divorce filing, since she would be unable to gather her belongings by then due to current stay-at-home orders in New York City. Olsen is claiming that Sarkozy ignored her request to extend their move-out date and that he terminated their lease without her knowledge.

Olsen is reportedly residing with her twin sister and codesigner, Ashley Olsen, in the meantime.
