Two of those customers recently filed a lawsuit in the northern district of California accusing the company of knowingly selling and marketing defective leggings, according to the Consumerist.
The plaintiffs, Julie Dean and Suzanne Jones, allege that the company has improperly advertised the quality of its leggings — and even ignored customer complaints pertaining to issues with the pants.
“Customers have complained that the leggings are of such poor quality that holes, tears, and rips appear before wearing, during the first use or shortly thereafter,” the lawsuit reads. “The leggings have also been described as tearing as easily as ‘wet toilet paper.’” Other problems with the products include leggings that have one leg that is substantially larger (or smaller) than the other, and leggings that are supposed to be for adults, but instead would only fit a child.”
These allegations are nothing new — there is already a Facebook group with almost 20,000 members, called ‘LuLaRoe Defective/Ripped/Torn Leggings and Clothes.’ Members post images of their torn leggings and detail their experiences with the brand.
The lawsuit alleges the company has modified the quality of its products to keep up with the retailer’s massive growth in past years.
“It is clear that Defendants have chosen to sacrifice the quality of their Products in order to meet the growing demand at the expense of Customers,” the suit reads. “The extent to which they have done this, however, is unacceptable.”
The lawsuit also names a particular instance in which a company official allegedly noted the poor quality of the leggings in a company-wide email. “With regard to the leggings, Patrick Winget, the head of production for Defendants, reportedly wrote: “The leggings may get holes, because we weaken the fibers to make them buttery soft. We have done all we can to fix them.”
Dean and Jones are suing the brand on behalf of themselves and LuLaRoe customers who purchased leggings after March 31, 2016. They are seeking “monetary damages, restitution, injunctive and declaratory relief” from LuLaRoe, according to the lawsuit.
In a statement to Yahoo Style, LuLaRoe said, “We categorically reject the fabricated and exaggerated claims of this suit in the strongest terms and believe it is completely without merit. We stand by the quality of our products and are committed to ensuring consumers are fully satisfied. We are confident we will be able to fully refute these allegations.”
