Previously unseen documents, detailing potential evidence that both Johnny Depp and Amber Heard's legal teams had hoped to submit during the defamation trial, show Depp's team pushed to include nude images of Heard. They also hoped to include references to her past job as an 'exotic dancer' – something that Heard fans have said somewhat smacks of misogyny and feels irrelevant to the televised case.
Within the newly unsealed pre-trial documents, which amass over 6,000 pages worth of material, Head's team request that the judge disregards the 'inappropriate' and 'irrelevant' material put forth by Depp's lawyers for consideration.
They write: "Mr. Depp inappropriately seeks to introduce evidence of the following Irrelevant Personal Matters: (1) nude pictures of Amber Heard; (2) Amber Heard's sister Whitney's reality show video; (3) Whitney and Amber's past romantic relationships; (4) Amber's brief stint as an exotic dancer years before she met Mr. Depp and Mr. Depp attempting to frivolously and maliciously suggest or imply that Ms. Heard was at one time an escort."
The documents, seen by Daily Beast, also contain an email to Heard from an attorney detailing how she waived her right to any of Depp's $33 million that he amassed while filming Pirates of the Caribbean 4, a movie shot during the course of their marriage (and which Heard could have claimed half the earnings of due to their lack of pre-nup).
The same series of proposed evidence also suggests Heard's team hoped to include Depp's medical records, showing that he has taken a drug called cialis (which is often prescribed to treat erectile dysfunction, benign prostatic hyperplasia or pulmonary arterial hypertension).
Ultimately, Judge Penney Azcarate ruled that none of the evidence from the couple's divorce proceedings was relevant to the defamation trial and therefore, up until now, these documents have remained out of the public eye – unlike the trial itself which was televised to millions of people around the world.
After losing his 2020 libel case in the UK, which saw Depp go head to head with The Sun newspaper after they branded him a 'wife beater' (something the court ruled to be 'substantially true'), the actor was victorious in the more recent defamation lawsuit in the US. The jury dictated that Heard must pay damages of $10 million to Depp, after her Washington Post op-ed about being a public figure for victims of domestic violence was found to be defamatory towards the Pirates star and harmed his career prospects.
