Jennifer Hudson Agrees to Let Her Son Spend Thanksgiving With His Father David Otunga
In the spirit of giving, Jennifer Hudson modified her emergency order of protection against ex-fiancé David Otunga to let their son spend Thanksgiving with him.
In court documents obtained exclusively by PEOPLE, the singer voluntarily agreed to allow their 8-year-old son, David Jr., to spend the holiday with Otunga after she filed an emergency order of protection last week.
David Jr. will be spending Thursday with his father from 3 p.m. until Friday at 7 p.m.
Otunga, 37, previously requested that Hudson’s protective order be thrown out on Tuesday, which was denied in court orders obtained by PEOPLE, so he could be with his son for the holiday.
Under the order of protection, Otunga is not entitled to any parenting time until their next court date and any time with his son would require Hudson’s written approval. The singer opted to give him that approval.
Otunga’s hearing to have Hudson’s order of protection dropped is set to Nov. 27 at 9:30 a.m. while the next hearing for to address custody is scheduled for Dec. 7.
PEOPLE has reached out to representatives for both Hudson and Otunga and has yet receive a response.
Hudson, 36, announced the end of her ten-year relationship to Otunga exclusively to PEOPLE on Thursday. The star was also granted an emergency order of protection from the former wrestler. In her request for the order, she accused him of ongoing harassing and threatening behavior and claimed he once pushed her inside their home.
“I am now living in fear of further action David might take,” The Voice star said in her request for the order. Otunga has denied any claims of abuse or harassment via his lawyer, who told PEOPLE he plans to file for primary custody.
“Mr. Otunga wants to make it very clear that he denies each and every allegation contained in that petition. Mr. Otunga is now and has always been the primary caregiver of the parties’ son,” his lawyer, Tracy Rizzo, tells PEOPLE on Friday.
On Thursday, Hudson’s rep told PEOPLE exclusively that the couple had split. “They have been in the process of ending their relationship for a number of months.”
“Today, Jennifer requested and received a protective order against her ex-fiancé. Jennifer’s actions are solely taken in the best interest of their son,” the statement concluded.
