This is wrong, In federal law, Congress can take private property directly (without recourse to the courts) by passing an Act transferring title of the subject property directly to the government. In such cases, the property owner seeking compensation must sue the United States for compensation in the U.S. Court of Federal Claims. The legislature may also delegate the power to private entities like public utilities or railroads, and even to individuals. The U.S. Supreme Court has consistently deferred to the right of states to make their own determinations of "public use"." Congress has the power to declare Eminent Domain, not the SCOTUS, not the President. The power has always resided with the Congress. Even declaring a National Emergency doesn't grant the President Powers he doesn't already have. There is a reason for that, if Declaring a National Emergency granted the President powers he didn't already have, then using that power you could unilaterally control the government, and thus violate the checks and balances that the Constitution has put into place, to prevent such a thing from occurring.
