Danielle Cohn Responds to Fans Who Are Criticizing Her Controversial Age Difference With BF Mikey Tua
Danielle Cohn recently got back together with her on-again-off-again boyfriend of two years, Mikey Tua. With that reconciliation came a lot of drama, especially considering the controversial age difference between Danielle and Mikey. But Danielle just made a TikTok letting everyone know she doesn't care what they think about her and her boyfriend's ages.
Basically, Danielle's age has been a mystery for awhile now. While she used to claim she was 15, back in September her father made a Facebook post saying Danielle was actually 13, which would made her 14 now as she celebrated a birthday in March.
Mikey, meanwhile, is 17 years old, turning 18 next week on June 2nd and that's where things get complicated. According to the California Penal Code 261.5, the legal age of consent is 18. That means that it is illegal to engage in sexual intercourse with someone under the age of 18, regardless of whether the sex is consensual or even initiated by the minor.
If there is less than a three year age difference between the adult and the minor, the act is considered a misdemeanor, but if the adult is three years or more older than the minor, it could be considered a felony. According to the California legislature, the adult could face up to a year in prison and/or a fine of $10,000.
Of course, as Mikey's 18th birthday approaches, many have been thinking about this legislation. Either way, Danielle and Mikey having sex is illegal, but if Danielle's dad is right and she is only 14, then it is also a felony, which comes with a greater punishment for Mikey.
Mikey and Danielle, though, seem totally unbothered by all of this. On Thursday, the TikTok star posted a video with Mikey along with the caption, "When they say 'your boyfriend is going to jail' 😂." In the video, the couple is lip synching to "Lead The Race (UNDEFEATED)" by Comethazine, which includes the lyrics, "Your opinion, you can keep it/I'm undefeated, I really don't need it."
Of course, Mikey and Danielle may not be engaging in sexual intercourse, in which case there would be nothing to worry about here. Danielle even denied that they were having sex in an Instagram comment where she also claimed to be 16.
There were also some DMs that leaked recently between Mikey's mother and someone else where Mikey's mom stated that she was in "close contact with the [Department of Children and Family Services] and LAPD." It's unclear if his mother will actually take action against her son following his birthday next week.
