After his 2020 sentencing on charges of rape and sexual assault, Harvey Weinstein’s conviction in New York City was overturned in April 2024.

The former Hollywood producer was first accused of sexual misconduct by more than 80 women in October 2017 and was formally charged in connection with two women's allegations in May 2018. Two years later, in February 2020, a N.Y.C. court found Weinstein guilty on charges of first-degree criminal sexual act and third-degree rape. He was sentenced to 23 years in jail.

In July 2021, Weinstein was extradited to Los Angeles, where he was found guilty of three of seven charges in December 2022. He was sentenced to an additional 16 years in jail to be served separately from his New York sentence.

However, in April 2024, Weinstein’s New York sentence was overturned as the Court of Appeals ruled that the trial judge did not provide a fair trial, per The Associated Press.

What was Harvey Weinstein accused of?

In October 2017, over 80 women in Hollywood accused Weinstein, who founded Miramax and later The Weinstein Company alongside his brother Bob Weinstein, of sexually assaulting and raping them. However, the 2018 prosecution focused on the charges brought by two women, per The New York Times: former production assistant Miriam “Mimi” Haleyi and aspiring actress Jessica Mann.

He was charged with two counts of rape, one count of criminal sexual act and two counts of predatory sexual assault. The New York jury found Weinstein guilty on two counts of criminal sexual assault, but not guilty on three other charges, which included predatory sexual assault.

Weinstein firmly denied the accusations, stating that his experiences with the women were consensual.

“While he was not convicted on the most serious charges, we are disappointed in the verdict and will be filing an appeal,” Weinstein’s lawyers, Donna Rotunno and Damon Cheronis, shared in a statement to PEOPLE following his 2020 conviction. “There are issues in this trial that were extremely troubling, and they prejudiced Mr. Weinstein’s ability to have his case fairly judged.”

Weinstein was sentenced to 23 years in prison in March 2020 in a New York court. However, he was later extradited to a Los Angeles court where he was charged with six new sexual assault counts, including three charges of forcible rape, in October 2020.

Two years later, the disgraced film producer was found guilty on one count of forcible rape, one count of forced oral copulation and one count of sexual penetration by a foreign object after the California jury deliberated for 10 days.

In February 2023, he was sentenced to an additional 16 years in prison after his 23-year sentence. During the trial, he continued to claim he was innocent.

"I maintain that I'm innocent. I never raped or sexually assaulted Jane Doe 1. I never knew this woman, and the fact is she doesn't know me. This is about money," Weinstein said in court ahead of his sentencing, according to CNN. "Please don't sentence me to life in prison. I don't deserve it."

Prior to the allegations, Weinstein had been married to Marchesa founder and designer Georgina Chapman since 2007. After he was accused of assault by dozens of women in October 2017, Chapman announced that she was separating from her husband, with whom she shares two children, India and Dashiell.

“My heart breaks for all the women who have suffered tremendous pain because of these unforgivable actions. I have chosen to leave my husband. Caring for my young children is my first priority and I ask the media for privacy at this time,” Chapman said in a statement to PEOPLE at the time.

Chapman and Weinstein reached a divorce settlement worth $15-20 million in January 2018, a source told PEOPLE at the time. She also got primary custody of their children.

In May 2018, Chapman spoke out about the allegations against her ex-husband for the first time in an interview with Vogue, stating that she “never” knew of her husband’s alleged behavior.

“There was a part of me that was terribly naive — clearly, so naive. I have moments of rage, I have moments of confusion, I have moments of disbelief! And I have moments when I just cry for my children,” she told the outlet. “What are their lives going to be? What are people going to say to them? It’s like, they love their dad. They love him. I just can’t bear it for them!”

Many critics pointed out that Chapman kept a purposely low profile after the allegations, canceling Marchesa’s runway show for their fall 2018 collection. She explained to Vogue that she used that period as a “time for mourning.”

“I was so humiliated and so broken . . . that . . . I, I, I . . . didn’t think it was respectful to go out. I thought, ‘Who am I to be parading around with all of this going on?’ ” she said. “It’s still so very, very raw. I was walking up the stairs the other day and I stopped; it was like all the air had been punched out of my lungs.”

The brand suffered following the allegations, but Chapman returned to the spotlight when she attended the Met Gala in May 2019, walking alongside Constance Wu, who wore a Marchesa gown.

In February 2020, PEOPLE confirmed that Chapman had moved on and was dating Oscar-winning actor Adrien Brody. “She finds [him] to be an interesting person with a deep passion for his work that is similar to hers,” a source told PEOPLE a month later.

They made their red carpet debut a year later at the Tribeca Film Festival in June 2021. The following month, Chapman and Weinstein finalized their divorce.

"Harvey's only thoughts are happiness for his family and the hope that his children are always cared for and happy,” Weinstein’s rep, Juda Engelmayer, told PEOPLE at the time. “He loves them and hopes that they know it, and that one day soon, he can be closer to them."

Why was Harvey Weinstein’s conviction overturned?

In April 2024, Weinstein’s 2020 conviction in New York was overturned after Weinstein’s lawyer, Arthur Aidala, claimed his client didn’t receive a fair trial. He alleged that the trial judge put Weinstein’s character on trial, rather than referring to evidence.

It is unclear whether Weinstein will face another trial for the charges he was originally convicted of.

“Today’s decision is a major step back in holding those accountable for acts of sexual violence," Douglas H. Wigdor — who represented eight alleged victims at the New York criminal trial — told PEOPLE in a statement. "Courts routinely admit evidence of other uncharged acts where they assist juries in understanding issues concerning the intent, modus operandi or scheme of the defendant. The jury was instructed on the relevance of this testimony and overturning the verdict is tragic in that it will require the victims to endure yet another trial.”

Is Harvey Weinstein still in jail?

Weinstein will remain in jail due to his 2022 sexual assault convictions in California. Per Reuters, he has been serving his 23-year sentence in a prison in upstate Rome, New York. In March 2020, he was moved from Riker's Island jail in N.Y.C. to Wende Correctional Facility, a maximum-security prison, in Erie County, New York.

Following the overturning of his New York State conviction, he will now be transferred to the custody of prison authorities in California, per ABC.
