Tory Lanez Requests Judge Vacate 10-Year Sentence, Cites Driver’s Statement

Tory Lanez has filed a petition requesting a judge vacate his 10-year sentence for shooting Megan Thee Stallion. The musician, legal name Daystar Peterson, cites “childhood trauma” and a new statement from his driver Jauquan Smith about the August 2020 incident.

According to court reporter Meghan Cunnif, Peterson has hired new legal representation who believe his past and the new account should be considered in the court’s decision. The filing argues that Peterson is “not an impact to public safety, as he not only has a high likelihood of rehabilitation, but moreover, he continues to urge that this was an isolated event.”

A three-judge panel confirmed the petition will be considered at the same time as Lanez’s pending appeal scheduled for Dec. 26, 2023. However, the court will likely not rule on the petition for at least a few months due to the amount of time needed for the Attorney General’s Office to file its brief.

Earlier this week, Megan Thee Stallion responded to Smith’s claim of witnessing Peterson’s attempt to take a firearm from her friend Kelsey Harris before the shots were fired.

“I know who shot me,” declared the Grammy Award-winning performer. “I said who shot me and that’s why you’re in jail…. You’re dragging online like there’s no evidence, there’s no new evidence… It’s 2024, y’all still fu**ing with me!”

Earlier this month, Peterson was convicted of three felony counts involving the shooting of Megan Thee Stallion: assault with a semiautomatic handgun, carrying a loaded, unregistered firearm in a vehicle, and discharging a firearm with gross negligence. He received his decade-long sentence in August 2023. Since his incarceration, Peterson has filed multiple motions and appeals requesting probation, therapy, and release.

Peterson is currently housed at the California Correctional Institution and eligible for parole in September 2029.
