Tommy Lee of Mötley Crüe Accused of Sexually Assaulting a Woman in a Helicopter

A lawsuit was filed against the drummer on Friday, claiming he sexually assaulted a woman during a 2003 private helicopter tour

A lawsuit has been filed against Tommy Lee alleging that he sexually assaulted a woman on a helicopter in 2003.

In a civil complaint obtained by PEOPLE, Mötley Crüe drummer, 61, has been accused of sexually assaulting a woman (who anonymously filed as Jane Doe) around February 2003 on a helicopter ride from San Diego to Van Nuys, California, which she claims she “was lured under false pretenses by Tommy Lee’s personal helicopter pilot, David Martz” to take.

The plaintiff is now requesting damages for sexual assault, gender violence, intentional infliction of emotional distress and negligence, and demanding a jury trial, according to the complaint filed on Dec. 15.

Representatives for Lee or his legal team did not respond to PEOPLE's multiple requests for comment.

In the filing, the plaintiff claims she was invited to the private flight by Martz and was not aware the musician would also be on the helicopter.

According to the filing, the plaintiff became familiar with Martz, as she frequently conducted business with him as his bank teller, and the two eventually became friends around “late 2001 or early 2002.”

Martz began inviting the woman to take a ride in his helicopter in mid-2002, which she perceived “as a friendly gesture,” per the complaint, but she was hesitant because she had never ridden on one before. During a January 2003 lunch, they agreed to arrange “a short helicopter tour sometime in February.”

The day of the tour, the plaintiff claims lunch plans they'd scheduled prior to the trip were canceled last minute. In the complaint, she recalls that upon arriving at the hangar where the aircraft was, Lee was present, and Martz informed the plaintiff “that he needed to take Lee to Van Nuys and that the trip would take no longer than 35 to 40 minutes, and then commanded Plaintiff to hop in the helicopter.”

Per the complaint, Martz and Lee allegedly consumed alcohol, marijuana and cocaine on board, and the pilot instructed the woman to “just relax” when she wasn’t drinking.

After the two men requested that the woman sit with them in the cockpit, with the drummer allegedly encouraging her to “sit on his lap so that she would not miss the view,” she felt “immense pressure” to join them and she alleged that “within a matter of minutes” Lee began “groping and kissing” her.

According to the documents, the “Plaintiff attempted to pull away from Lee, but he only became more forceful” and she claims that Lee began “penetrating her with his fingers, and attempting to force her to perform oral copulation.”

Throughout the incident, Martz — who died in a 2015 plane crash — allegedly “merely watched on, smiling” and the plaintiff ceased communication with him after the incident.

The event “caused the Plaintiff to suffer great shock, distress, humiliation, shame, and guilt,” and, per the documents, she claims “Martz and Lee conspired to lure other women … onto Martz’s helicopter under the guise of taking a tour.”

Lee has a history of legal trouble. During his marriage to Pamela Anderson, he served six months in prison in 1998 over charges of spousal abuse.

The rocker shares two sons with his ex-wife — Brandon Thomas Lee, 27, and Dylan Jagger Lee, 25 — and has been married to influencer/comedian Brittany Furlan since 2019.
